This site, selfhost.dev, is owned and operated by Swatantra Cloud Systems Pvt Ltd. (referred to as SelfHost, we, or company). Please carefully read and understand these Terms and Conditions before using any services or products from selfhost.dev.
Your access to and use of this website and its products indicate acceptance and agreement to be bound by these terms. If you do not agree with these terms, you should leave the site immediately and not use any materials or services available here.
1. Definitions
- "SelfHost," "Company," "we," "our," or "us" means SelfHost Technologies Pvt. Ltd. (or the applicable legal entity operating the Services).
- "Customer," "you," or "your" means the individual or legal entity accessing or using the Services.
- "Customer Data" means all data, databases, software, configurations, credentials, files, backups, logs, and other information submitted to, stored on, processed by, or deployed through the Services.
- "Third-Party Providers" means independent service providers integrated with or used alongside the Services, including cloud infrastructure providers and payment processors.
- "Order" means any subscription, plan selection, or purchase of paid Services.
2. Eligibility & Authority
To use the Services:
- You must be at least 18 years of age.
- You must have the legal capacity to enter into binding agreements.
- If acting on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.
You are responsible for ensuring that your use of the Services complies with applicable laws and regulations in your jurisdiction.
3. Description of Services
SelfHost provides software tools and infrastructure management capabilities designed to enable customers to provision, manage, monitor, automate, and maintain self-hosted or cloud-based database and server environments.
The Services may include, but are not limited to:
- Database provisioning and orchestration
- Infrastructure configuration management
- Monitoring and alerting systems
- Automated backup management
- Deployment automation tools
- Role-based access management
- Integrations with external cloud providers
SelfHost reserves the right to improve, modify, suspend, or discontinue features at its discretion.
4. Account Registration & Security
4.1 Account Creation
To access the Services, you must create an account and provide accurate, current, and complete information. You agree to promptly update any information that becomes inaccurate.
4.2 Account Responsibility
You are solely responsible for:
- Maintaining confidentiality of login credentials
- Restricting access to your account
- Ensuring authorized users comply with these Terms
- All activities conducted through your account
You must notify SelfHost immediately of any unauthorized use, suspected security breach, or compromise of credentials. SelfHost shall not be liable for any loss or damage resulting from your failure to secure your account credentials.
5. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Services to violate any applicable law or regulation
- Host or distribute malware, ransomware, spyware, or malicious code
- Attempt to gain unauthorized access to any systems or networks
- Conduct denial-of-service attacks
- Use the Services for illegal financial activities
- Engage in crypto-mining or high-resource workloads without disclosure
- Circumvent platform security measures
SelfHost may investigate suspected violations and suspend or terminate accounts that breach this section.
6. Customer Data & Ownership
6.1 Ownership
All rights, title, and interest in Customer Data remain solely with you. SelfHost does not claim ownership over your databases, infrastructure configurations, application code, or stored content.
6.2 Limited License
You grant SelfHost a limited, worldwide, non-exclusive license to process Customer Data solely for:
- Providing the Services
- Performing technical support
- Ensuring platform security
- Complying with legal obligations
6.3 Data Responsibility
You are solely responsible for:
- The legality and integrity of your data
- Maintaining backups where necessary
- Ensuring appropriate encryption and access control
- Compliance with applicable data protection laws
7. Data Protection & Privacy
SelfHost processes personal data in accordance with its Privacy Policy. Where applicable under data protection laws:
- You act as the Data Controller
- SelfHost acts as the Data Processor
SelfHost implements reasonable technical and organizational measures to safeguard data but does not guarantee absolute security.
8. Third-Party Services & Infrastructure
SelfHost integrates with third-party infrastructure providers such as Amazon Web Services. These providers operate independently of SelfHost.
SelfHost does not control and is not responsible for:
- Third-party outages
- Infrastructure downtime
- Pricing adjustments
- Service interruptions
- Data centre failures
9. Shared Responsibility Model
SelfHost provides orchestration and automation tools but does not assume responsibility for infrastructure decisions made by Customers.
You are responsible for:
- Configuring firewalls and security groups
- Managing credentials and encryption keys
- Enabling and validating backups
- Applying security patches where required
- Regulatory compliance of hosted data
10. Backups & Data Recovery
SelfHost may provide automated backup functionality. However:
- Backup activation is your responsibility
- Backup validation and restoration testing is your responsibility
- Recovery time objectives are not guaranteed unless separately agreed
SelfHost shall not be liable for data loss arising from user misconfiguration, third-party infrastructure failure, or external events.
11. Fees & Payment
- Subscription fees are billed in advance
- Usage-based charges may apply where specified
- Failure to pay may result in suspension or termination
- Fees are non-refundable unless required by law
- You are responsible for all applicable taxes, excluding taxes based on SelfHost's income
12. Beta or Experimental Features
SelfHost may offer beta, preview, or experimental features. Use of beta features is at your own risk. Such features:
- May contain errors
- May be modified or discontinued
- Are provided without warranties
- Should not be relied upon for mission-critical workloads
13. Intellectual Property
All intellectual property rights in the Services, including software code, UI designs, workflows, documentation, trademarks, and proprietary technology, are owned exclusively by SelfHost. You may not:
- Reverse engineer or decompile the platform
- Copy proprietary architecture
- Resell or sublicense the Services without written consent
14. Confidentiality
Each party agrees to protect confidential information disclosed in connection with the Services. Confidential information includes non-public technical, financial, and business information. It does not include information that:
- Is publicly available
- Was independently developed
- Is lawfully obtained from a third party
15. Suspension & Termination
SelfHost may suspend or terminate Services if:
- You breach these Terms
- You fail to pay fees
- Continued use poses security risks
- Required by law
Upon termination:
- Access to the Services will cease
- Customer Data may be retained for up to 30 days for export
- Thereafter, data may be permanently deleted
16. Disclaimer of Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. SelfHost disclaims all warranties, whether express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
We do not guarantee uninterrupted or error-free operation.
17. Limitation of Liability
To the maximum extent permitted by law, SelfHost shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of revenue, profits, or data
- Business interruption
Total aggregate liability shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.
18. Indemnification
You agree to defend, indemnify, and hold harmless SelfHost from claims, damages, liabilities, and expenses arising from:
- Your use of the Services
- Violation of these Terms
- Infringement of third-party rights
- Regulatory non-compliance
19. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
20. Force Majeure
SelfHost shall not be liable for failure or delay resulting from events beyond reasonable control, including natural disasters, government actions, internet failures, infrastructure outages, labor disputes, or cyberattacks.
21. Changes to Terms
SelfHost may modify these Terms from time to time. Material changes will be communicated via the website or email. Continued use of the Services after updates constitutes acceptance of the revised Terms.
